Welcome to EduNet365 (the "Platform"), including the EduNet365 mobile application and web-based school management system.

These Terms of Use ("Terms") govern your access to and use of the EduNet365 platform operated by EduNet365 ("we," "our," or "us").

By downloading, accessing, or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform.

2. Eligibility and Authorized Use

EduNet365 is intended solely for authorized users of educational institutions that have subscribed to the EduNet365 system, including:

  • School administrators
  • Teachers and staff
  • Students
  • Parents or legal guardians

You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials confidential
  • Be fully responsible for all activities under your account

Unauthorized access or use of the Platform is strictly prohibited.

3. License and Access Rights

Subject to compliance with these Terms, EduNet365 grants subscribing institutions and their authorized users a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for educational and administrative purposes.

If EduNet365 provides a self-hosted or API-based deployment option:

  • The license allows institutions to host the system on their own servers where applicable
  • The license may not be transferred, sublicensed, or assigned without prior written consent from EduNet365

All rights not expressly granted are reserved.

4. Intellectual Property Rights

All content, software, features, functionality, designs, logos, trademarks, text, graphics, and other materials available on the Platform are the exclusive property of EduNet365 or its licensors and are protected under applicable intellectual property laws.

You may not:

  • Copy, reproduce, modify, distribute, or create derivative works
  • Reverse engineer or attempt to extract source code
  • Publicly display or commercially exploit any part of the Platform

5. User Conduct

By using EduNet365, you agree that you will NOT:

  • Use the Platform for unlawful or fraudulent purposes
  • Interfere with or disrupt the Platform's operation
  • Attempt to gain unauthorized access to any account, server, or system
  • Upload malicious code, viruses, or harmful content
  • Misuse academic or student data

All users must use the Platform solely for legitimate educational and school administrative purposes.

6. School Data Responsibilities

Educational institutions using EduNet365 are responsible for:

  • Ensuring they have lawful authority to collect and process student data
  • Obtaining necessary parental or guardian consents
  • Ensuring compliance with applicable local and national laws

Schools may collect and manage student data including, but not limited to:

  • Names
  • Dates of birth
  • Unique student IDs
  • Photographs
  • Academic records
  • Attendance records
  • Financial or fee information

Schools may also be legally required to share student information with government authorities or regulatory bodies. By using the Platform, users acknowledge and accept such data processing practices.

7. Privacy

Your use of EduNet365 is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of information as outlined in the Privacy Policy.

8. Service Availability

We strive to ensure continuous access to the Platform; however, we do not guarantee uninterrupted or error-free service. Access may be temporarily suspended for:

  • Maintenance
  • System upgrades
  • Security updates
  • Technical issues beyond our control

EduNet365 shall not be liable for temporary service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, EduNet365 shall not be liable for any:

  • Indirect
  • Incidental
  • Special
  • Consequential
  • Punitive damages

Including but not limited to loss of profits, data loss, goodwill, service interruption, or unauthorized access to data arising out of or related to:

  • Your use or inability to use the Platform
  • Unauthorized access to or alteration of your data
  • Actions or conduct of third parties

Use of the Platform is at your own risk.

10. Indemnification

You agree to indemnify and hold harmless EduNet365, its directors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your violation of these Terms
  • Misuse of the Platform
  • Violation of any law or third-party rights

11. Modifications to the Terms

EduNet365 reserves the right to modify or update these Terms at any time. Updates will become effective immediately upon posting the revised Terms within the Platform or on our official website.

Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

12. Termination

We reserve the right to suspend or terminate access to the Platform:

  • If you violate these Terms
  • If required by law
  • If your institution's subscription expires or is terminated

Upon termination, your right to access the Platform will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Chhattisgarh, India, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Chhattisgarh, India.
